1) Your Agreement With Us (Electronic Signatures)
By using www.mikedavis.realtor and our other online services, and by submitting forms or clicking to accept this Privacy Policy and/or our Terms of Use, you enter a binding agreement with Davis Realty Services LLC and our affiliated brokers/agents. Your clicks and form submissions are your electronic signature and have the same effect as signing on paper.

2) What This Policy Covers
This Policy explains what personal information we collect, how we use and share it, and your choices. It applies to our website, mobile experiences, email lists, and any features we operate (collectively, the “Web Properties”). It does not cover websites or apps we do not control. Using our Web Properties also means you agree to our Terms of Use.
3) How We Communicate (TCPA/CASL Consent)
Your consent. When you provide contact information, you expressly agree we may contact you at the emails and phone numbers you provide (now or later) about real-estate services and related offers.
Channels. Email, calls, voicemail, fax, and texts (SMS/MMS). We may use automated tools (autodialers, prerecorded/AI voices, “robotexts”). Carrier charges may apply. Consent isn’t required to purchase goods or services.
Opting out.
• Texts: reply STOP (you may receive a confirmation).
• Email: click Unsubscribe or contact us.
• Other channels: contact us via the info above.
Please allow reasonable time to process (up to 30 days if not using automated methods).
Your statements. You confirm you’re 18+, reside in the U.S. (or in Canada—see below), are the account holder or have authority for the numbers/emails, and your info is accurate (and you’ll update us if it changes). Some mobile features may not work with all devices/carriers.
For Canadian residents. In addition to the above, you consent to communications consistent with CASL, PIPEDA, and applicable provincial laws. Messages may continue while you’re considering real-estate services and until you opt out. Your information may be processed in the United States.
4) Dispute Resolution—Arbitration & Class-Action Waiver
Please read—this affects your rights. Except for the specific exceptions below, either of us can require that any claim or dispute related to this Policy, our Terms, or your use of the Web Properties be resolved by binding arbitration instead of court. No class actions or representative proceedings are allowed in arbitration or court.
Your right to opt out. You may reject arbitration by mailing a signed notice within 30 days of first agreeing to the Terms/Policy to:

Include your name, address, phone number, and the date you agreed. Opting out applies only to this arbitration clause.
Covered claims. “Claim” is broad and includes most disputes related to the Policy, Terms, communications, marketing, transactions, or services. Not covered: a court deciding the validity/scope of this clause or the class-waiver; requests for temporary court orders; self-help remedies; and individual small-claims cases (unless moved/appealed elsewhere).
Starting & rules. Arbitration will be administered by AAA or JAMS before a single neutral arbitrator (attorney with 10+ years’ experience or retired judge). The arbitrator applies applicable law (including statutes of limitation) and may award the same types of relief available in court to an individual party.
Location & costs. Any hearing you attend will be reasonably near your residence. Fees follow the administrator’s rules. Where required by law or this clause, we will cover certain fees; you may also request fee waivers from the administrator. Attorney’s fees may be awarded as permitted by law/rules.
Appeals. For Claims over $25,000, an appeal to a three-arbitrator panel may be available; the panel reviews de novo.
Class-action waiver (material term). Claims must be brought individually—no class, consolidated, representative, or private-attorney-general claims. If a court finally rules the waiver unenforceable for a Claim seeking public injunctive relief, that portion proceeds in court while individual monetary Claims proceed in arbitration.
5) Governing Law & Changes
Except for the arbitration clause (governed by the Federal Arbitration Act), this Policy and the Terms of Use are governed by Texas law without regard to conflicts rules.
We may update this Policy or the Terms at any time by posting the revised version here. Changes are effective upon posting. Continued use after posting means you accept the updates. You may opt out of future changes by writing to us; your opt-out takes effect 10 days after receipt, and the prior version will continue to govern.
6) Information We Collect
A) Personal Information may include:
• Contact details (name, address, email, phone, title/company)
• Demographics (date of birth, nationality/country of residence)
• Professional details (company, job function)
• Marketing preferences
• Property inquiries/service requests; event registrations; feedback
• Payment/financial info when needed to process a transaction
• Photos/videos you submit
• Any other info you choose to provide
B) Usage/Browsing Information may include:
• IP address, device identifiers (e.g., MAC, UDID), device type/OS
• Browser type/language, headers, protocol data
• Pages viewed, links clicked, visit time/date/length, referrers
• On authenticated areas, we may associate browsing with your profile
You can choose not to provide information; some features/services may then be unavailable.
7) How We Collect Information
• Directly from you (forms, emails, calls, chats, sign-ups, account creation)
• Automatically from your device when you use the Web Properties
• From service providers, advertising/analytics partners, and other lawful sources
Cookies & Similar Technologies
We use cookies and similar tools to operate the site, remember preferences, understand usage, and measure marketing. You can adjust your browser to block/delete cookies; some features may not work correctly if you do.
Analytics, Pixels & Session Tools
We use common analytics and session technologies (tracking pixels, clear GIFs, session replay) to understand site use and improve performance and marketing.
• Meta (Facebook) Pixel. Helps show relevant ads and measure results. Manage ad preferences in Facebook settings.
• FullStory. Session insights to improve user experience; pseudonymized profiles; opt-out available at FullStory’s site.
• Google Analytics. Traffic/engagement measurement; opt-out browser add-on available.
• Microsoft Clarity. Interaction analytics (clicks, scrolls, navigation).
We may add or remove analytics tools over time.
Chat & Virtual Assistant
We may offer live-chat and/or AI-powered chat. Messages you send may be logged and reviewed to answer questions, support your account, and improve services. AI responses may be incomplete or incorrect; please verify important information. Davis Realty Services LLC is not liable for damages from reliance on chat content or temporary unavailability.
Web Beacons & Unique IDs
Some pages/emails include web beacons to check if content was viewed. We may assign unique IDs to personalize content and measure effectiveness.
8) How We Use Information
• Operate & Improve. Provide features, process requests, maintain accounts, fix bugs, enhance usability, personalize content.
• Communicate. Service updates, property alerts, and marketing (per your preferences/consents). Every marketing email includes an unsubscribe link.
• Provide Services You Request. Connect you with local brokers/agents or participating lenders when you ask us to do so.
• Recruiting. Consider job applications and retain them for future roles unless you ask us not to.
We may use aggregated or de-identified data for any lawful purpose.
9) When We Share Information
We do not sell your Personal Information. We may share:
• Service Providers & Affiliates. With subsidiaries, affiliates, and trusted vendors performing services for us under confidentiality/data-use terms (some may process data outside the U.S.).
• Referrals You Request. With local real-estate professionals or lenders when you request a connection.
• Business Transfers. In connection with a merger, asset sale, financing, or similar transaction (including bankruptcy or reorganization).
• Legal & Safety. To comply with law, respond to lawful requests, or protect rights, safety, and property.
• With Your Direction or Consent.
10) Security
We use administrative, technical, and physical safeguards designed to protect personal information. No system is perfect. Protect your credentials and notify us immediately of any unauthorized access.
11) Access, Correction, Deletion
• Access/Update: Use your account settings (if available) or contact us to review/correct your information.
• Delete: Use any “Delete my Personal Information” link we provide or contact us. We may verify your identity and retain data where required or permitted by law.
12) Children
Our Web Properties are not directed to children under 13, and we do not knowingly collect information from them.
By using the Web Properties, you affirm that you are at least 18 years old, or that you are an emancipated minor, or that you have the consent of a parent/legal guardian. You also affirm that you are fully capable of agreeing to and complying with this Privacy Policy and our Terms of Use.
If we learn that we have collected personal information from a child under 13 without verified parental consent, we will delete that information as quickly as possible, in compliance with the Children’s Online Privacy Protection Act (COPPA).
Parental Rights. Parents or legal guardians who believe their child under 13 may have provided us with personal information can:
• Request to review the information we may have collected,
• Ask that we delete the child’s information from our records, and
• Refuse to allow any further collection or use of the child’s information.

13) Links to Other Sites
We may link to third-party sites. Their privacy practices are their own; review their policies. Our use of Google API data complies with the Google API Services User Data Policy (Limited Use).
14) International Visitors
If you access our services from outside the U.S., you understand your information may be transferred to, stored in, and processed in the United States or other countries with different data-protection laws.
15) Your Choices
You can choose what to share. Some features require certain information. You can opt out of specific uses (like marketing) as described here; we’ll also make reasonable efforts to notify certain third parties we’ve shared with, where applicable.
16) State-Specific Notices
California “Shine the Light.” California residents may request once per year information about certain personal data we shared for third-party direct marketing in the prior calendar year (if any). Email “Request for California Privacy Information” to mikedavis201380@yahoo.com.

Oregon. We will not share your Personal Information with non-affiliates for marketing unless we first inform you and you have a chance to opt out.
Vermont. We will not disclose information about your creditworthiness to affiliates, and we will not share your personal/financial/credit-report/health information with non-affiliates to market to you, except as permitted by Vermont law or with your authorization.

17) “Do Not Track”
Industry standards for DNT signals aren’t uniform, so we do not alter our practices in response to DNT at this time.
